Please read these Terms of Service ("Terms") carefully before using Ethyra (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
1. Use of Service
You must be at least 13 years old to create an account. By creating an account, you affirm that you meet this age requirement.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate information and to use the Service only for lawful purposes.
2. Teacher Authorization and School Official Status
By creating a class and sharing a class code with students, you represent and warrant that:
- You are a teacher, instructor, or authorized representative of an educational institution
- You are acting as a school official with a legitimate educational interest in using the Service for your students
- You are authorized by your school or educational institution to consent to the collection and use of student data for the educational purpose of AI-assisted grading
- You will use the Service and student data solely for educational purposes
You acknowledge that you bear responsibility for ensuring your use of Ethyra is consistent with your school's policies regarding educational technology and student data.
3. Intellectual Property
The Service and its content are owned by Ethyra and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purposes.
You retain full ownership of all content you upload (assignments, rubrics, submissions, grades). We do not claim ownership of your content.
4. Privacy
Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to the collection, use, and disclosure of your information as described therein. The Service is hosted in the United States.
5. Payment and Subscriptions
Ethyra offers a free trial with limited submissions. Paid subscriptions are billed monthly or annually. You can cancel at any time through your account settings; cancellation takes effect at the end of the current paid term. We may change prices at any time and will communicate changes in accordance with applicable law.
6. Prohibited Activities
You agree not to: misuse the Service; attempt to gain unauthorized access; interfere with security features; harass other users; upload malicious content; scrape, reverse engineer, or copy the Service; use automated tools (bots, scrapers) to access the Service; or use the Service in violation of any applicable law.
7. AI Grading Disclaimer
Ethyra uses AI to assist with grading. AI-generated grades and feedback are suggestions and should be reviewed by the teacher. Ethyra does not guarantee the accuracy of AI output. Teachers are ultimately responsible for all grades assigned.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED, SECURE, OR ERROR-FREE OPERATION OF THE SERVICE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ETHYRA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL ARISING FROM YOUR USE OF THE SERVICE.
10. Indemnification
You agree to indemnify and hold harmless Ethyra and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
11. Termination
We may terminate or suspend your account at any time, without notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware. Any dispute shall first be attempted to be resolved through informal negotiation for at least 30 days. If unresolved, disputes will be settled by binding arbitration under the rules of the American Arbitration Association. Arbitration shall be individual only — no class actions.
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting updated Terms on the Service. Continued use after changes constitutes acceptance of the revised Terms.
